1. Acceptance of Terms

Welcome to Fight IQ Cup (the “Service”). By accessing or using our mobile application and website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

Fight IQ Cup is operated by La Superica EURL, 49 Avenue du Maréchal Juin, 64200 Biarritz, France (“we,” “us,” or “our”).

2. Description of Service

2.1 Free Prediction Game

Fight IQ Cup is a free-to-play, skill-based prediction game focused on mixed martial arts (MMA) events. The Service allows users to:

  • Make predictions about fight outcomes using virtual coins
  • Compete with other users on leaderboards
  • Track prediction accuracy and performance statistics
  • Engage with the MMA community

2.2 No Gambling or Betting

IMPORTANT: Fight IQ Cup is NOT a gambling or betting platform. Key distinctions include:

  • No Real Money Wagering: Users never wager or risk real money on predictions
  • No Purchase Required: All prediction features are accessible without payment
  • No Cash Prizes: Users cannot win real money or monetary prizes
  • Virtual Currency Only: “Coins” are purely virtual, have no monetary value, and cannot be purchased, exchanged, or transferred
  • Skill-Based Competition: Success is based on MMA knowledge and prediction skill

3. Eligibility

You must be at least 13 years old to use this Service. If you are under 18, you must have parental or guardian consent. The Service is available globally except where prohibited by law.

4. Virtual Coins System

Virtual coins in Fight IQ Cup:

  • Are provided free of charge to all users
  • Have no monetary value whatsoever
  • Cannot be purchased, sold, traded, or exchanged for real currency
  • Cannot be transferred between users
  • Are solely for tracking prediction performance and leaderboard rankings
  • May be reset, modified, or removed at our discretion

5. Subscriptions

Fight IQ Cup offers optional premium subscriptions that unlock additional features. Subscriptions are processed through Apple in-app purchase (iOS). Subscription fees are clearly displayed before purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple Account Settings.

6. User Conduct

You agree NOT to:

  • Use the Service for any illegal gambling or betting activities
  • Create multiple accounts to manipulate leaderboards
  • Use bots, scripts, or automated tools to gain unfair advantages
  • Harass, abuse, or harm other users
  • Attempt to hack, compromise, or reverse engineer the Service
  • Violate any applicable laws or regulations

Violations may result in warning, temporary suspension, permanent account termination, or legal action.

7. Intellectual Property

All content, features, and functionality of the Service are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy of fight information or uninterrupted availability of the Service. TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total liability shall not exceed $100 USD.

10. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, including changes to scoring systems, coin allocations, or game mechanics, without notice.

11. Termination

You may terminate your account at any time through the app settings or by emailing us. We may terminate or suspend your access immediately, without notice, for violation of these Terms or any other reason at our sole discretion.

12. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with French arbitration law, except where prohibited by applicable law.
